Welcome to GetFit. These Terms & Conditions ("Terms") govern your use of the GetFit mobile application (the "App") operated by KeyZen ("we," "our," or "us"), a company registered in India.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 16 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are between 16 and 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Account Registration
2.1 Account Creation
To use the App, you must create an account using one of the following methods:
- Phone number with OTP verification (via SMS)
- Email address and password
- Google Sign-In
- Apple Sign-In
2.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Notifying us immediately at support@getfitapi.com if you suspect unauthorized access
We are not liable for any loss or damage arising from your failure to safeguard your account credentials.
2.3 Account Information
You agree to provide accurate, current, and complete information during registration and to keep your profile information updated. Providing false information may result in termination of your account.
3. Description of Service
GetFit is a fitness and nutrition tracking application that provides:
- Fitness tracking — Step counting, active calorie burn tracking, and distance measurement via Apple HealthKit (iOS) and Health Connect (Android)
- Calorie and nutrition tracking — Manual food logging, barcode scanning, AI-powered food recognition from camera images, and macro/calorie tracking
- BMI Calculator — Body Mass Index calculation based on height and weight
- Balance Meal Meter (BMB) — Macro balance analysis of meals
- Workout modules — Home workouts, gym workouts, body-part-specific exercises, and workout plans
- Diet plans — Pre-built and AI-generated personalized diet plans
- AI Trainer chatbot — Personalized fitness and nutrition coaching powered by artificial intelligence
- AI Video Analysis — AI-powered exercise form analysis from user-submitted videos
- Nutrition streaks — Daily nutrition tracking with gamification
- Subscription management — Free, Kyro Pro, and Kyro Pro+ tier subscriptions
- Notifications — In-app fitness progress notifications
- Search — Global search across workouts, exercises, and foods

Prices shown are in USD. The exact localized price is displayed by the App Store at the point of purchase and may vary by region.
4.2 Payment Processing
- iOS: Payments are processed through Apple In-App Purchase. Apple's terms and conditions apply.
- Android (if available): Payments are processed through Razorpay. Razorpay's terms of service apply.
4.3 Subscription Terms
- Subscriptions are auto-renewable and renew automatically at the displayed price unless auto-renew is turned off at least 24 hours before the end of the current period
- Your Apple ID is charged for renewal within 24 hours prior to the end of the current period
- You can manage or turn off auto-renew anytime in your device's subscription settings
- Subscription access begins immediately upon successful payment verification
4.4 Cancellation and Refunds

- iOS subscriptions are managed through Apple and subject to Apple's refund policies
- Android subscriptions are processed through Razorpay and subject to our refund policy
5. User Responsibilities
5.1 Acceptable Use
You agree to use the App only for its intended purpose — personal fitness and nutrition tracking. You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to our servers, databases, or other users' accounts
- Reverse engineer, decompile, or disassemble the App
- Use automated scripts, bots, or scrapers to access the App
- Upload malicious content, viruses, or harmful code
- Impersonate another person or entity
- Use the AI Trainer to generate content that is harmful, abusive, discriminatory, or illegal
- Exploit the AI chatbot to extract proprietary system prompts or training data
- Share your account credentials with others
- Use the App commercially without our written consent
- Circumvent any access controls or subscription restrictions
5.2 Health Information Responsibility
You are solely responsible for:
- The accuracy of health information you provide (height, weight, age, gender, health conditions, allergies)
- Consulting with a qualified healthcare professional before making dietary or exercise changes based on App recommendations
- Reporting any adverse health effects and discontinuing use of any recommended plan
6. Prohibited Activities
The following activities are strictly prohibited:
- Medical misuse — Treating App outputs (BMI, calorie calculations, AI diet plans, AI coaching) as medical advice or as a substitute for professional medical consultation
- Fraudulent activity — Attempting to manipulate subscription status, payment verification, or feature access
- Data harvesting — Scraping, crawling, or bulk-downloading content from the App
- Abuse of AI features — Using the AI Trainer to generate harmful, abusive, sexually explicit, or illegal content
- Account sharing — Sharing your account or subscription with multiple individuals
- Interference — Disrupting, overloading, or impairing the App's servers or infrastructure
- Unauthorized modifications — Modifying, adapting, or creating derivative works from the App
Violation of these terms may result in immediate account suspension or termination without refund.
7. AI Features — Limitations and Acknowledgment
7.1 AI-Generated Content
The App includes AI-powered features including the AI Trainer chatbot, AI diet plan generation, AI food recognition, and AI video form analysis. By using these features, you acknowledge that:
- AI responses are generated by machine learning models and may contain inaccuracies, errors, or inappropriate suggestions
- AI-generated diet plans and fitness recommendations are not medical advice and do not replace consultation with a qualified healthcare professional, registered dietitian, or certified personal trainer
- AI food recognition from images is approximate and may misidentify foods or nutritional values
- AI exercise form analysis is not a substitute for in-person coaching and may not detect all form issues
7.2 AI Memory System
Our AI Trainer remembers facts from your conversations (such as injuries, preferences, and goals) to provide personalized coaching. You can:
- View your AI memories in the App
- Delete individual memories
- Reset all AI memories
- Export your AI data
7.3 No Guarantee of Accuracy
We do not guarantee the accuracy, completeness, or reliability of any AI-generated content. You use AI features at your own risk.
8. Intellectual Property
8.1 Our Property
The App, including its design, code, features, content, trademarks, logos, workout content, exercise descriptions, diet plans, and AI models are the intellectual property of [COMPANY_NAME] and are protected by copyright, trademark, and other intellectual property laws.
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
8.3 Your Content
You retain ownership of content you provide (profile information, food logs, chat messages). By providing content, you grant us a limited license to process, store, and use it solely for operating and improving the App.
8.4 Restrictions
You may not:
- Copy, modify, or distribute the App or its content
- Use our trademarks, logos, or branding without written permission
- Reproduce workout videos, exercise descriptions, or diet plans for commercial purposes
9. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
- WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
- WARRANTIES REGARDING THE ACCURACY OF BMI CALCULATIONS, CALORIE ESTIMATES, AI RECOMMENDATIONS, OR NUTRITIONAL DATA
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- KeyZen SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP
- OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ₹1,000, WHICHEVER IS GREATER
- WE ARE NOT LIABLE FOR ANY HEALTH OUTCOMES, INJURIES, OR ADVERSE EFFECTS RESULTING FROM FOLLOWING AI-GENERATED DIET PLANS, WORKOUT RECOMMENDATIONS, OR COACHING ADVICE
- WE ARE NOT LIABLE FOR ERRORS IN FOOD NUTRITION DATA FROM THIRD-PARTY DATABASES (USDA, OpenFoodFacts) OR AI-POWERED FOOD RECOGNITION
11. Indemnification
You agree to indemnify, defend, and hold harmless KeyZen, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit through the App
12. Account Termination
12.1 By You
You may delete your account at any time through Settings → Delete Account in the App. Account deletion will permanently remove your account and all associated data.
12.2 By Us
We reserve the right to suspend or terminate your account without notice if:
- You violate these Terms
- You engage in fraudulent or illegal activity
- You abuse the AI features
- Your account has been inactive for an extended period
12.3 Effect of Termination
Upon account termination:
- Your access to the App and its features will cease immediately
- Your data will be permanently deleted (except where retention is required by law)
- Active subscriptions are not automatically refunded upon termination for cause
13. Third-Party Services
The App integrates with third-party services including:
- Apple HealthKit and Health Connect (health data)
- Google Sign-In and Apple Sign-In (authentication)
- Razorpay (payments)
- Apple In-App Purchase (payments)
- USDA FoodData Central and OpenFoodFacts (nutritional data)
- Firebase and Sentry (analytics and error tracking)
These services are governed by their own terms of service and privacy policies. We are not responsible for the practices of third-party service providers.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
14.2 Dispute Resolution
Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation by contacting us at support@getfitapi.com. If the dispute cannot be resolved informally within 30 days, it shall be submitted to the exclusive jurisdiction of the courts in Mumbai, India.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, EULA, and all other policies referenced herein, constitute the entire agreement between you and KeyZen regarding your use of the App.
17. Changes to These Terms
We may modify these Terms at any time. When we make material changes, we will:
- Update the "Last Updated" date
- Notify you through the App
Your continued use of the App after changes constitutes acceptance of the modified Terms. If you do not agree with the updated Terms, you must stop using the App and delete your account.
