App Store (iOS) users: GetFit is licensed under Apple's standard Licensed Application End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. That agreement governs your licence to use the GetFit iOS app. The terms below apply to non-App Store distribution and set out our additional app-specific terms (health and AI disclaimers, subscriptions, and acceptable use), which apply alongside it.
This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and KeyZen ("Licensor," "we," "our," or "us"), governing your use of the GetFit mobile application (the "App").
By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree, do not download, install, or use the App.
Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial purposes.

The App, including all code, design, graphics, user interfaces, visual elements, workout content, exercise descriptions, AI models, algorithms, databases, and documentation, is owned by KeyZen and protected by copyright, trademark, patent, trade secret, and other intellectual property laws of India and international treaties.
This EULA does not transfer any ownership rights to you. You acquire only the limited license to use the App as specified herein.
Content you create within the App (food logs, chat messages, profile data) remains your property. You grant us a non-exclusive, worldwide, royalty-free license to process, store, and display this content solely for the purpose of providing the App's services to you.

The AI system stores facts extracted from your conversations to personalize future interactions. You can manage (view, delete, export) AI memories through the App at any time.
THE APP IS DESIGNED FOR GENERAL FITNESS AND NUTRITION TRACKING PURPOSES ONLY. IT IS NOT A MEDICAL DEVICE AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR HEALTH CONDITION.
BY USING THE APP, YOU ACKNOWLEDGE THAT:
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the practices described in the Privacy Policy.
You may terminate this EULA at any time by deleting the App and your account.
We may terminate this EULA and your access to the App if you breach any provision of this EULA, without prior notice and without liability.
Upon termination:
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KeyZen BE LIABLE FOR:
You agree to indemnify and hold harmless KeyZen from any claims, damages, expenses, or losses arising from your use of the App, your breach of this EULA, or your violation of any law or third-party rights.
You agree to comply with all applicable export control laws and regulations and agree not to export or re-export the App to any prohibited country or individual.
This EULA shall be governed by the laws of India. Any disputes arising from this EULA shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.
If you downloaded the App (the "Licensed Application") from the Apple App Store, the following additional terms apply. These terms satisfy the minimum terms required by Apple for a custom end user license agreement, and they prevail over any conflicting term elsewhere in this EULA.
You and KeyZen acknowledge that this EULA is concluded between you and KeyZen only, and not with Apple Inc. ("Apple"). KeyZen, not Apple, is solely responsible for the Licensed Application and the content thereof. This EULA does not provide for usage rules for the Licensed Application that conflict with the Apple Media Services Terms and Conditions, which KeyZen acknowledges it has had the opportunity to review.
The license granted to you for the Licensed Application is a limited, non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the Licensed Application may be accessed and used by other accounts associated with you, the purchaser, via Family Sharing or volume purchasing.
KeyZen is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA or as required under applicable law. You and KeyZen acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
KeyZen is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be KeyZen's sole responsibility.
You and KeyZen acknowledge that KeyZen, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the Licensed Application's use of the HealthKit framework. Nothing in this EULA limits KeyZen's liability to you beyond what is permitted by applicable law.
You and KeyZen acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, KeyZen, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with applicable third-party terms of agreement when using the Licensed Application. For example, you must not be in violation of your wireless data service agreement when using the Licensed Application.
You and KeyZen acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

If any provision of this EULA is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
This EULA, together with the Privacy Policy and Terms & Conditions, constitutes the entire agreement between you and KeyZen regarding the App.
