This Disclaimer of Liability applies to your use of the GetFit mobile application (the "App") operated by KeyZen.
1. General Disclaimer
THE APP AND ALL CONTENT, FEATURES, SERVICES, AND RECOMMENDATIONS PROVIDED THROUGH IT ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
KeyZen EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY — We do not warrant that the App is fit for any particular commercial purpose
- FITNESS FOR A PARTICULAR PURPOSE — We do not warrant that the App will meet your specific health, fitness, or dietary goals
- NON-INFRINGEMENT — We do not warrant that the App does not infringe any third-party rights
- ACCURACY — We do not warrant that any data, calculations, recommendations, or AI-generated content is accurate, complete, or reliable
- AVAILABILITY — We do not warrant that the App will be available at all times or free from interruptions
- SECURITY — While we implement reasonable security measures, we do not warrant that the App is completely secure from unauthorized access
2. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
2.1 Excluded Damages
KeyZen, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of data, profits, revenue, business opportunities, or goodwill
- Personal injury or health-related damages
- Emotional distress or psychological harm
- Damages arising from unauthorized access to your account
- Damages arising from third-party services (Razorpay, Apple, Google, Twilio, etc.)
- Damages arising from interruption or unavailability of the App
2.2 Liability Cap
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF:
- The total amount you paid to KeyZen in subscription fees during the twelve (12) months preceding the claim, OR
- ₹1,000 (Indian Rupees One Thousand)
2.3 Essential Purpose
THE LIMITATIONS AND EXCLUSIONS IN THIS SECTION APPLY EVEN IF THE REMEDY FAILS OF ITS ESSENTIAL PURPOSE AND REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE).
3. Specific Disclaimers
3.1 Health and Fitness
- We are not responsible for any injuries, health complications, or adverse effects from following workout routines, diet plans, or fitness recommendations in the App
- BMI, calorie calculations, and macro targets are estimates and not medical advice

3.2 AI-Generated Content
- We are not responsible for errors, inaccuracies, or inappropriate content in AI-generated responses
- AI diet plans, workout recommendations, and coaching advice may not be suitable for your individual circumstances

3.3 Nutritional Data
- Food nutritional information is sourced from third-party databases (USDA FoodData Central, OpenFoodFacts) and AI estimations
- We do not guarantee the accuracy of nutritional data
- Barcode scanning and AI food recognition provide approximate results only
3.4 Third-Party Services
We are not responsible for:
- Apple HealthKit or Health Connect data accuracy
- Razorpay payment processing issues
- Apple In-App Purchase processing issues
- Twilio SMS delivery failures
- Third-party API availability or data accuracy
3.5 User-Generated Content
You are solely responsible for the accuracy and appropriateness of any content you provide through the App, including health information, food logs, and chat messages.
4. Force Majeure
We shall not be liable for any failure to perform our obligations where such failure results from circumstances beyond our reasonable control, including but not limited to:
- Natural disasters
- Government actions or regulations
- Internet or telecommunications failures
- Third-party service outages
- Cyberattacks or security breaches beyond our control
- Pandemics or public health emergencies
5. Indemnification
You agree to indemnify, defend, and hold harmless KeyZen and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, expenses, or costs (including reasonable attorneys' fees) arising from:
- Your use of the App
- Your violation of these terms or any applicable law
- Your violation of any third-party rights
- Any content you submit through the App
- Health decisions you make based on App information
6. Applicability
This disclaimer applies to all features and services within the App, including but not limited to:
- Free and premium features
- AI Trainer chatbot
- Diet plans (pre-built and AI-generated)
- Workout plans and exercises
- BMI and calorie calculators
- Balance Meal Meter
- Food logging and recognition
- Barcode scanning
- Step and activity tracking
- Nutrition streaks
- Video form analysis
7. Severability
If any provision of this disclaimer is found to be unenforceable, the remaining provisions shall remain in full force and effect.
8. Governing Law
This disclaimer shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.
